1. Introduction

Welcome to Storywiz! These Terms of Service ("Terms") govern your use of the Storywiz website, Storywiz application, and Storywiz Chrome extension (collectively, "Storywiz Services"), owned and operated by Storywiz Inc. Please read these Terms carefully as they contain important information about your legal rights, remedies, and obligations. By accessing or using the Storywiz Services, you agree to be bound by these Terms and all terms incorporated by reference. These Terms include everything in this document, as well as those in the Privacy Policy.

You must be at least 13 years of age to use the Storywiz Services. By agreeing to these Terms, you represent and warrant that you are at least 13 years of age.

2. Account Registration

To use certain features of the Storywiz Services, you may be required to create a Storywiz account ("Account") and provide us with a username, password, and certain other information about yourself as set forth in the Privacy Policy.

You are solely responsible for the information associated with Your Account and anything that happens related to Your Account. You must maintain the security of your Account and promptly notify Storywiz if you discover or suspect that someone has accessed your Account without your permission.

3. User Content

The Storywiz Services allow you to create, post, send, receive, and store content, including but not limited to text summaries and visual stories ("User Content"). You retain all rights in and to your User Content, as between you and Storywiz.

By creating, posting, or sharing your User Content with the Storywiz Services, you grant Storywiz a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, modify, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Storywiz Services and our business operations.

4. Fair Use Policy

Storywiz’s services are provided for personal, non-commercial use. We implement a fair use policy to prevent abuse and to maintain a high-quality service for all users. If we detect unusually high activity on your account, or activity which is disruptive to our systems, we may take action which can include limiting your use of the Storywiz Services.We can’t and won’t be responsible for you using AudioPen in a way that breaks the law. You also agree that you will not use AudioPen in a manner that:

  • Is fraudulent or threatening to Storywiz system or jeopardizes the security of your Storywiz account or any other user;
  • Attempts, in any manner, to obtain the password, account, or other security information of any other user;
  • Violates the security of any computer network, or cracks any passwords or security encryption codes;
  • Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying system.

5. Changes to these Terms

We may make changes to these Terms from time to time. If we make changes, we will post the amended Terms to our Services and update the "Last Updated" date above. We may also attempt to notify you by sending an email notification to the address associated with your account or providing notice through our Services. Unless we say otherwise in our notice, the amended Terms will be effective immediately, and your continued use of our Services after we provide such notice will confirm your acceptance of the changes.

6. Termination

We may terminate or suspend your access to the Services at any time, for any reason at our discretion. If we do so, it's important to understand that you don't have a contractual or legal right to continue to use our Services. We will try to provide advance notice to you prior to our terminating your account so that you are able to retrieve any important Posts you may have uploaded to your account, but we may not do so if we determine it would be impractical, illegal, not in the interest of someone’s safety or security, or otherwise harmful to the rights or property of AudioPen.

7. Limitation of Liability

To the maximum extent permitted by law, Storywiz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, good-will, or other intangible losses.

8. Dispute Resolution

You agree that any dispute between you and Storywiz arising out of or relating to these Terms, the Storywiz Services, or any other Storywiz products will be decided only by arbitration, individually and not on a class-wide basis.
